Terms of Use

Summary: Use ChessPulse AI for legitimate chess preparation. You are responsible for the PGN data you upload. Don't use our platform to cheat in online games. Respect the chess community.

1. Acceptance of Terms

By accessing or using ChessPulse AI ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you may not use the Service.

2. Description of Service

ChessPulse AI is a chess preparation and training platform that uses artificial intelligence to:

  • Analyze publicly available chess games from Lichess
  • Train neural network models that replicate a player's chess style
  • Provide practice games against AI-generated player mimics
  • Generate player fingerprints and style analysis
  • Offer opening repertoire training and coaching tools

The Service is intended as a preparation and training tool for over-the-board (OTB) chess competitions, similar to studying an opponent's published games.

3. Account Registration

To use the Service, you must:

  • Sign in using a valid Google account
  • Be at least 13 years of age
  • Provide accurate information
  • Maintain the security of your account credentials

You are responsible for all activity that occurs under your account.

4. Acceptable Use

4.1 Permitted Uses

  • Preparing for over-the-board chess tournaments and matches
  • Studying opponent playing styles for competition preparation
  • Improving your own chess skills through practice
  • Analyzing your own games and playing patterns
  • Training AI models on publicly available Lichess game data
  • Training AI models on PGN files that you own or have the right to use

4.2 Prohibited Uses

You agree NOT to use the Service to:

  • Cheat in online chess: Do not use AI-generated insights to gain an unfair advantage during live online games on any platform. ChessPulse AI is a preparation tool, not a real-time cheating tool.
  • Harass or stalk: Do not use player analysis features to harass, stalk, or target specific individuals.
  • Violate third-party rights: Do not upload PGN files that contain proprietary or copyrighted game annotations that you do not have the right to use.
  • Abuse the Service: Do not attempt to circumvent rate limits, overload our systems, or exploit vulnerabilities.
  • Misrepresent: Do not claim that AI-generated play represents the views, endorsement, or affiliation of any real chess player.
  • Reverse engineer: Do not attempt to extract, reverse engineer, or copy our AI models, training pipelines, or proprietary algorithms.
  • Resell or redistribute: Do not resell access to the Service or redistribute trained models.

5. PGN Upload and Data Ownership

5.1 Your Responsibility

You are responsible for ensuring you have the right to use any PGN files you upload. By uploading a PGN file, you represent and warrant that:

- You own the games contained in the PGN, OR

- The games are publicly available and free to use, OR

- You have obtained permission from the rights holder to use the games for AI training purposes

ChessPulse AI is not responsible for verifying ownership of uploaded PGN files. If you upload PGN data that you do not have the right to use, you assume all legal responsibility.

5.2 Privately Uploaded Data

PGN files you upload and AI models trained from your uploaded data:

  • Remain associated with your account only
  • Are not shared with other users
  • Are not used to train models for other users
  • Will be deleted upon your request or account deletion

5.3 Publicly Available Data

When you request training on a Lichess username, we access publicly available game data through the Lichess API. This data is already accessible to anyone. AI models trained on publicly available data may be cached and made available to other users requesting the same player.

6. Lichess Data Usage

ChessPulse AI accesses chess game data from Lichess in accordance with the following principles:

  • Public data only: We only access games and data that are already publicly available through the Lichess API
  • API compliance: We comply with Lichess API rate limits and terms of service
  • Community benefit: Our use of Lichess data is for chess education, training, and competition preparation — consistent with the open-source, community-benefit mission of Lichess
  • Fair use: We analyze game patterns and train AI models for the purpose of chess study, which constitutes transformative and educational use of publicly available game records
  • No redistribution: We do not redistribute raw game data downloaded from Lichess. Data is processed and transformed into AI models that serve a fundamentally different purpose than the original game records
  • Respect for players: Any Lichess user may request that their publicly available games be excluded from our training system by contacting us

7. Intellectual Property

7.1 Our Intellectual Property

The ChessPulse AI platform, including its AI models, training pipeline, neural network architecture, user interface, and branding, is our intellectual property. You may not copy, modify, distribute, or create derivative works from our platform without our written permission.

7.2 Open Source Acknowledgment

ChessPulse AI is built upon open-source software. We acknowledge and are grateful for the following projects and their contributors:

  • Stockfish — Open-source chess engine, licensed under GPL v3
  • python-chess — Chess library for Python, licensed under GPL v3
  • PyTorch — Machine learning framework, licensed under BSD
  • Lichess — Open-source chess platform and API, licensed under AGPL v3
  • FAISS — Vector similarity search library by Meta, licensed under MIT

Our use of these projects complies with their respective open-source licenses. See our Acknowledgments page for full details.

7.3 Chess Games

Chess game moves are facts and are not subject to copyright. The sequence of moves in a chess game is a factual record of events. Our analysis and AI models based on these move sequences are transformative works.

8. Fair Play and Ethics

ChessPulse AI is committed to fair play in chess. We believe that:

  • Preparation is not cheating. Studying your opponent's games before a tournament is a time-honored chess tradition. Our platform digitizes and enhances this preparation process.
  • AI assistance during games is cheating. Using any computer assistance during a live rated game (online or OTB) is unethical and against the rules of all chess organizations. ChessPulse AI is for preparation only.
  • Respect for opponents matters. Use our analysis tools responsibly. Player fingerprints and style analysis are for competitive preparation, not for harassment or public shaming.

We reserve the right to suspend or terminate accounts that we reasonably believe are using our Service to facilitate cheating in chess competitions.

9. Service Availability and Limitations

  • The Service is provided "as is" without warranties of any kind
  • AI models are approximations of a player's style, not perfect replications
  • We do not guarantee uninterrupted service availability
  • Training times depend on server load and may vary
  • We reserve the right to modify, suspend, or discontinue features at any time

10. Tokens and Payments

If applicable, the following terms apply to token-based purchases:

  • Tokens are a digital currency valid only within ChessPulse AI
  • Token purchases are non-refundable except where required by law
  • If a training job fails due to a system error, tokens will be refunded automatically
  • Tokens do not expire
  • We reserve the right to modify token pricing with reasonable notice

11. Limitation of Liability

To the maximum extent permitted by law:

  • ChessPulse AI is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service
  • Our total liability for any claim related to the Service is limited to the amount you have paid to us in the 12 months preceding the claim
  • We are not responsible for chess tournament outcomes, ratings changes, or competitive results based on preparation using our Service

12. Indemnification

You agree to indemnify and hold harmless ChessPulse AI from any claims, damages, or expenses arising from:

  • Your use of the Service in violation of these Terms
  • PGN data you upload that infringes on third-party rights
  • Your use of AI-generated insights to cheat in chess competitions
  • Any misrepresentation regarding your right to use uploaded data

13. Account Termination

We may suspend or terminate your account if:

  • You violate these Terms of Use
  • We reasonably believe you are using the Service for cheating
  • You abuse our systems or attempt to circumvent security measures
  • Your account has been inactive for more than 12 months

You may delete your account at any time. Upon deletion, your privately uploaded data and trained models will be permanently removed.

14. Changes to Terms

We may update these Terms of Use from time to time. We will notify registered users of material changes. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation before pursuing formal legal action.
